Workplace Delegate Rights Fact Sheet

Workplace delegates are individuals appointed or elected by an employee organisation to represent union members in a specific enterprise. Effective from 15 December 2023, the Fair Work Act was amended to provide these delegates with enhanced protections and wide-ranging rights to represent the industrial interests of both current and potential union members.

  • Regulated Workers: Rights extend beyond standard employees to include certain independent contractors and road transport contractors.
  • Employer Obligations: Employers must not unreasonably fail to deal with delegates or hinder the exercise of their rights.
  • Delegate Duties: Delegates must still comply with reasonable workplace policies and must not disrupt normal work performance.
