Brief Overview

The monetary cap for recovering unpaid entitlements via the small claims process has increased from $20,000 to $100,000. This took effect from 1 July 2023.

The Secure Jobs Better Pay Act, which came into effect in December 2022, introduced significant changes to Australia’s small claims process in the Fair Work system.

These modifications allow for an employee to make a claim against their employer for unpaid monies up to $100,000 for up to 6 years after the alleged underpayment. The small claims process can also be used for certain disputes about casual conversion.
